The Delivery Club program is operated by Chick-fil-A, Inc. (“Chick-fil-A”) and subject to the specific Terms and Conditions provided below, as well as the Terms and Conditions of Use available at www.chick-fil-a.com/legal (“Terms and Conditions of Use”) (incorporated here by this reference) and the Chick-fil-A One® Terms & Conditions available at  (incorporated here by this reference) (collectively, the “Terms”). Defined terms from the Terms not otherwise defined below are incorporated here by this reference.
By purchasing a membership or otherwise enrolling in the Delivery Club program, you agree to be bound by these Terms. If you do not agree to these Terms, then you should not start a trial or otherwise enroll in the Delivery Club program. Should you object to any of the Terms, or any subsequent modifications thereto, or become dissatisfied with the Delivery Club program, your sole remedy is to discontinue participation in the program and properly cancel your account in the manner provided below.
I. General. Delivery Club program is an automatically renewing membership program requiring recurring payments. Membership automatically renews every 30 days until cancelled by you or Chick-fil-A. Eligible Chick-fil-A One members who enroll in the Delivery Club program will receive qualifying orders via Chick-fil-A Delivery without paying the applicable standard delivery fee. This agreement is between you and Chick-fil-A; it is not an agreement between you and an Operator (restaurant). Pursuant to this agreement, Chick-fil-A agrees to cover the standard delivery fee with the participating Operator (restaurant) so that you pay no standard delivery fee for an order. A minimum purchase before applicable taxes and fees is required (which may vary by location) for delivery. Qualifying orders must be placed from a participating restaurant location within the delivery radius of the restaurant and during available delivery hours (which may vary by location and change without notice). Menu prices for delivery are higher than at restaurant locations, and applicable taxes, service fees, and related surcharges still apply. The delivery fee does not include a voluntary tip or gratuity provided to the driver. Sales taxes and other government taxes and fees may apply.
Program is limited and unavailable in some states. Delivery Club program is valid only for use on qualifying orders via Chick-fil-A Delivery. Excludes third party delivery and catering orders. Your Delivery Club membership is personal, nontransferable and limited to one membership per Chick-fil-A One® account. Benefits may not be purchased, sold, bartered, brokered or otherwise transferred. Offers and benefits are specific to a Chick-fil-A One member’s account, unless otherwise stated.
II. Enrollment. Must have a valid Chick-fil-A One® account and be located in a participating market to enroll. To enroll, you must (i) provide the requested information by registering online and (ii) select a payment method for recurring payments. Chick-fil-A reserves the right to limit or modify enrollment at any time and to accept or refuse membership at our discretion. Chick-fil-A is not responsible for your inability to receive or redeem benefits or other loss due to your failure to maintain a valid Chick-fil-A One account, including, without limitation, due to any violation of the Chick-fil-A One® Terms and Conditions .
III. Fees and Renewal. Applicable fees will be charged upon enrollment or at the conclusion of your promotional trial, if applicable. Fees exclude applicable taxes. Initial fee is an introductory price and subject to change. Chick-fil-A reserves the right to change the fees at any time. Notice of a change in fees is provided by email. Changes will apply to new enrollments and renewal of existing membership if you do not cancel.
If the details of your selected payment method change, the issuer of your payment method may provide us with updated details that we may use to charge your fees in order to help prevent any interruption to your benefits. If the eligible payment method we have stored for you is declined for payment of fees, you must provide a new eligible payment method promptly or your Delivery Club account will be placed on hold and all benefits suspended. If you provide a new eligible payment method and are successfully charged, your account and benefits will be reactivated and your new membership period will be based on the date of the successful change. We reserve the right to terminate your benefits at the end of your applicable membership term if we are unable to successfully charge an eligible payment method.
UNLESS YOU NOTIFY US BEFORE A RECURRING CHARGE THAT YOU WANT TO CANCEL, YOU UNDERSTAND THAT YOUR DELIVERY CLUB MEMBERSHIP WILL AUTOMATICALLY CONTINUE AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU, EXCEPT AS REQUIRED BY APPLICABLE LAW) TO CHARGE THE PAYMENT METHOD WE HAVE STORED FOR YOU TO COLLECT THE THEN-APPLICABLE FEE AND TAXES.
IV. Cancelation; Refund Policy. Except as expressly stated in these Terms and Conditions, NO REFUNDS are provided upon cancelation after the payment is processed. Delivery Club memberships automatically renew unless canceled by you or by Chick-fil-A. You may cancel your membership and authorization for recurring payments at any time. To cancel, submit request online at https://order.chick-fil-a.com/account/delivery-club/cancel at least 48 hours prior to expiration of any trial period or your next scheduled payment to avoid further charges. Delivery Club memberships cannot be canceled or refunded in restaurant.
Cancellation is effective at the end of the then-current period for your membership and you will continue to receive eligible Delivery Club benefits until the effective date of cancelation (provided you are in compliance with the Terms). The terms of Section VII apply upon cancelation.
V. Promotional Trials. If you receive a promotional trial of Delivery Club, the trial will apply at the start of your membership for the stated promotional period. When your trial period has expired, your membership will automatically continue at the applicable fee. Your selected payment method will be charged unless you cancel the membership no later than 48 hours prior to expiration of the trial period. Limit of one trial per Chick-fil-A One account. Chick-fil-A reserves the right to limit eligibility or duration to prevent abuse of the promotional trials. Certain limitations may apply with combining a trial with any other offers.
VI. Updates. Chick-fil-A reserves the right to change or modify the Delivery Club program, any or all benefits under the program, or these Terms and Conditions or, at any time, for any reason, If Chick-fil-A elects to modify in a material way the Delivery Club program, any benefits, or these Terms and Conditions, Chick-fil-A will provide a notice of the material modification by posting the modifications or notice to the CFA Online Services and updating the Last Updated date. We may also attempt to notify you in other ways. Any modifications will become effective immediately after such posting or other such notification. We encourage you to review these Terms and Conditions regularly for modifications. Your continued participation in Delivery Club program following any updates shall constitute notice and acceptance of any such updates.
VII. Cancelation; Termination. Chick-fil-A may suspend or terminate, at Chick-fil-A’s sole and absolute discretion, any Delivery Club account if Chick-fil-A is unable to successfully charge an eligible payment method, if you dispute the charge of program fees with the issuer of your payment method, or if Chick-fil-A believes the member has abused program privileges, acted inconsistently with these Terms and Conditions or applicable law, or acted in a manner harmful to our interests. Termination by Chick-fil-A of your Delivery Club account will result in cancelation of all associated benefits, and Chick-fil-A has no obligation to refund you any fees following such termination by Chick-fil-A. In some cases you may still receive messages (which may have been scheduled prior to the account termination) after termination of enrollment. Chick-fil-A shall be the sole arbiter in cases of suspected abuse, fraud or violation of the Terms, and any decision it makes relating to termination or disabling of Delivery Club membership shall be final and binding.
Chick-fil-A reserves the right to terminate the Delivery Club program, or any of its benefits, at any time, for any reason. If Chick-fil-A terminates the Delivery Club program, Chick-fil-A will provide notice of termination in accordance with these Terms. Upon termination, at Chick-fil-A’s election, Chick-fil-A will either maintain the Delivery Club benefits until expiration of the applicable membership terms or refund a pro rata portion of the membership fee for the remaining portion of the applicable membership term.
VIII. No Warranties/Limitation of Liability.
Chick-fil-A makes no representations or warranties regarding the Delivery Club program. THE DELIVERY CLUB PROGRAM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, OF ANY KIND OR NATURE, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, ACCURACY, NON-INFRINGEMENT, OR FITNESS FOR ANY PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE DELIVERY CLUB PROGRAM WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE USE OF THE DELIVERY CLUB PROGRAM AND SERVICES MADE AVAILABLE THROUGH THE DELIVERY CLUB PROGRAM, OR THE RESULTS OBTAINED THEREFROM.
IN NO EVENT SHALL WE OR ANY OF OUR THIRD-PARTY SERVICE PROVIDERS, PARTNERS, OR THE LIKE BE LIABLE TO ANY PERSON FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, INCLUDING, BUT NOT LIMITED TO, ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR OTHER DAMAGES (LOST PROFITS, BUSINESS INTERRUPTION, OR LOSS OF INFORMATION, PROGRAMS, OR DATA) RESULTING FROM YOUR USE OF OR INABILITY TO USE THE DELIVERY CLUB PROGRAM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL CHICK-FIL-A’S CUMULATIVE LIABILITY FOR DAMAGES (DIRECT OR OTHERWISE) EXCEED IN THE AGGREGATE THE MONTHLY FEE THAT USER HAS PAID, IF ANY, FOR THAT USER’S CURRENT DELIVERY CLUB MEMBERSHIP. BECAUSE SOME STATES DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, IN SUCH JURISDICTIONS, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.
